PROMOTION

AND JAPAN WHO ARE AT LEAST 21 YEARS OF AGE OR OLDER AS OF AUGUST
15, 2007 TO ENTER ANY PART OF THIS PROMOTION. PROMOTION BEGINS ON
AUGUST 15, 2007 AND ENDS ON OCTOBER 31, 2007. INTERNET ACCESS REQUIRED.
As the Worldwide Partner of the Beijing 2008 Olympic Torch Relay,
Lenovo (Singapore) PTE. LTD. (“Sponsor”) announces a
call for entries for the “Lenovo Olympic Torchbearers Sweepstakes
and Contest” (the “Promotion”).
ELIGIBILITY: The Promotion is open only to legal
residents of the United States, Canada (excluding residents of Quebec),
United Kingdom, Brazil, Mexico, Argentina (excluding residents of
the Province of Cordoba and Mendoza), Russia, Germany, Italy, India
and Japan who are at least 21 years or older as of the first day
of the Promotion (August 15, 2007). Void in the provinces of Quebec,
Cordoba and Mendoza and where prohibited or otherwise restricted
by law. Winning a prize pursuant to this Promotion is expressly
contingent upon, and subject to, the validity of this Promotion
under the laws and regulations of such potential winner’s
country of residence (or subdivision thereof). The Sponsor, its
employees, contractors, directors and officers, and their respective
parents, subsidiaries, franchisees, divisions, affiliates, suppliers,
distributors, advertising and promotional agencies, as applicable,
and their respective officers, directors, shareholders, members,
employees, agents, successors and assigns, and all others associated
with the development, promotion, evolvement and execution of this
Promotion (the “Promotion Entities”) are ineligible
to participate in this Promotion. The Promotion Entities and their
immediate families (defined as spouse, mother, father, sisters,
brothers, sons and daughters, regardless of where they reside) and
members of their households (whether related or not) are ineligible
to participate in this Promotion. Participation in the Promotion
constitutes entrant's full and unconditional agreement to and acceptance
of these Official Rules, including, but not limited to, entrant’s
consent to receive email messages from Sponsor in connection with
the Promotion. No purchase is necessary to enter or win, and no
obligation of any kind is implied. Prizes shall not be exchanged
for cash.
There are two phases in this Promotion. Phase I requires participants
(“Participants”) to submit an original essay. Phase
II requires Participants to create a 30-second video submission.
Participation will require access to the internet and video-making
equipment. Phase I of this Promotion begins at 10:00 a.m. Eastern
Daylight Savings Time (“EDST”) on August 15, 2007 and
ends at 11:59 p.m. EDST on September 30, 2007. Only those entrants
that are selected as finalists (“Finalists”) in Phase
I will be eligible for Phase II of the Promotion, which begins at
10:00 a.m. EDST on October 10, 2007 and ends at 11:59 p.m. EDST
on October 31, 2007.
How to Enter Phase I: Go to http://www.lenovo.com/torch
and complete the online registration form. As part of the entry
process Participants must submit an original essay up to 50 words
in length and in English on the topic, "What makes you a New
Thinker for a New World?" (“Essay”). More details
on how we would describe a “New Thinker” is provided
below. In event of a dispute regarding the identity of the person
submitting an online entry, the entry will be deemed to be submitted
by the person in whose name the email address is registered at the
time of entry. Limit one (1) entry per person and per email address.
Normal Internet access and phone/usage charges imposed by your on-line/phone
service will apply. By submitting an Essay to the website provided
above, each Participant agrees, for zero compensation, to grant
to Sponsor all intellectual property rights in the Essay and each
of the constituent parts, which rights include, without limitation,
the Sponsor’s right to publish, make available to the public
and/or reproduce the Essay through any media available for the purpose
of administering and conducting the Promotion. All Participants
acknowledge and agree that Sponsor may use any ideas from the Essay,
whether or not such Essay has been awarded a prize.
Drawings and Prizes for Phase I: A drawing shall
be held once a week (“Weekly Drawing”) between August
15, 2007 and September 30 2007, such Weekly Drawings to take place
on August 22, 29, September 5, 12, 19 & 26, 2007. At each such
Weekly Drawing, one first prize winner (“First Prize Winner”)
will be randomly chosen from among all entries that comply with
the Official Rules of the Promotion (“Eligible Entries”)
received by such Weekly Drawing date and each First Prize Winner
will be awarded one (1) limited-edition, "Cloud of Promise"-themed
Lenovo 3000 V200 notebook computer (approximate retail value $1,999.00
USD each). Additionally, at each such Weekly Drawing, one hundred
(100) second prize winners (each, a “Second Prize Winner”)
will be chosen from among all Eligible Entries received by such
Weekly Drawing date and each Second Prize Winner shall be awarded
one (1) Lenovo Olympic Torch Relay Pin commemorating the Lenovo-designed
"Cloud of Promise" Beijing 2008 Olympic Torch and Beijing
2008 Olympic Torch Relay (approximate retail value $5.00 USD each).
Entries that have been selected as First Prize Winners or Second
Prize Winners will be excluded from subsequent Weekly Drawings.
Sponsor reserves the right to award prizes to less than 100 Second
Prize Winners if insufficient Eligible Entries have been received
by any Weekly Drawing Date. Odds of winning depend on the number
of Eligible Entries received. Any applicable taxes, customs or duties
on any prize are solely the responsibility of the applicable winner.
Before being declared a winner, residents of Canada, Brazil and
Argentina must also correctly answer, without assistance of any
kind, whether mechanical or otherwise, a time-limited mathematical
or cultural skill-testing question, as applicable, to be administered
by Sponsor. If the potential winner does not successfully complete
the skill-testing question within the time specified by Sponsor,
or does not respond to the prize notification within seven (7) days,
the potential winner will be disqualified and an alternate winner
may be selected. All decisions of Sponsor are final and binding
in all matters relating to this Promotion. Prize fulfillment will
occur 6-8 weeks after the winning date.
The total value of all prizes in Phase I of this promotion is approximately
$14,994.00 USD. There are no cash alternatives to any prize
Finalist Selection-Phase I:
Judging: Judges designated by Sponsor (“Judges”)
will select twenty (20) Finalists (“Finalists”) and
ten (10) alternates (“Alternates”), based on the essay
judging criteria (“Essay Judging Criteria”) set forth
below, from all Eligible Entries received prior to 11:59 p.m. EDST
on September 30, 2007. The Judges, whose decisions will be final,
shall judge the Essays submitted by eligible Participants according
to the following Judging Criteria:
• 20% for how inspirational or motivating the candidate has
been in his/her community
• 20% for examples of unique and non-traditional problem-solving
• 20% for examples of imaginative thinking beyond national
and cultural limitations
• 20% for examples of independence in thoughts and actions
• 20% for examples of new ways of acting to achieve new goals
Each of the 20 Finalists (and 10 Alternates) selected to proceed
to Phase II of the Promotion will be notified via email of their
selection and will be provided video content instructions for Phase
II no later than 11:59 pm. EDST on October 3, 2007. The 20 Finalists
(and 10 Alternates) will be asked to confirm receipt of the notification
email no later than 11:59 pm. EDST on October 4, 2007. In the event
that any of the initial twenty (20) Finalists are deemed ineligible,
for any reason, at any time pursuant to these Official Rules or
otherwise, each such Finalist will be replaced by one (1) Alternate
chosen by Sponsor by random drawing from the pool of Alternates
at which time such selected Alternate shall be deemed a Finalist.
Any selected Alternate who is a resident of Canada, Brazil or Argentina
must correctly answer a mathematical or cultural skill-testing question,
as applicable, without assistance of any kind, whether mechanical
or otherwise, before being declared a Finalist.
Phase II
The twenty (20) Finalists selected (and 10 alternates) must submit
via the internet at http://www.lenovo.com/torch
a 30-second video (“Submission”) showcasing how their
idea demonstrates “new thinking” and upholds the Olympic
ideals substantially in accordance with the video content instructions
for Phase II delivered to the Participant on or before October 3,
2007.
“New Thinkers” can be described as follows:
• Motivating – One who inspires the community to achieve
goals and conquer obstacles
• Provocative – One who disregards traditional boundaries
in carrying out a great and difficult endeavor
• Imaginative – One who thinks “outside the box”
– outside of national and cultural limitations
• Individualistic – One who demonstrates independence
in both his/her thoughts and his/her actions
• Explorative – One who seeks new ways of doing and
achieving
All Submissions must meet the standards set out in the Submission
Requirements below and be submitted by 11:59 p.m. EDST on October
7, 2007. If Sponsor, at its sole discretion, decides that a Submission
does not satisfy the Submission Requirements, it shall select one
of the Alternates in accordance with the methodology set forth above
to take the place of the ineligible Submission. Sponsor, at its
sole discretion, reserves the right to limit the number of Finalists
if it deems there to have been a sufficient number of Eligible Entries
or entries of insufficient quality. All Finalists will have their
videos posted to the Lenovo Torchbearer Contest Video Voting Page
no later than 10:00 a.m. EDST on Oct. 10, 2007.
Finalist Submission Requirements:
A. Submissions can be up to thirty (30) seconds in length and cannot
exceed twenty (20) megabytes.
B. Submissions must be in the English language or be subtitled in
English.
C. Submissions must be the original creation of the Finalist.
D. Finalists agree to and understand that Submissions will be made
available to the public, including but not limited to posting on
the Internet. Whether or not Submissions are published on the Internet,
Sponsor does not guarantee any confidentiality with respect to any
Submission.
E. Participants are responsible for securing necessary permissions,
talent and location releases and licenses for visual and audio material
contained in the Submissions.
F. Submission may not contain persons under the age of 21 years
old, depict someone smoking or intoxicated, contain an advertisement
or a solicitation of any business; or include an impersonation of
someone.
G. Submissions may not contain unsafe behavior or situations, profanity,
nudity, pornographic images or explicit sexual themes, graphic violence,
defamatory or libelous statements or material considered illegal.
Entries containing any such aspects and/or that are in violation
of law or otherwise deemed by Sponsor, in its sole discretion, to
be prejudicial to Sponsor or inappropriate in any way will be disqualified.
Submission determined to infringe on any intellectual property rights
or other rights, will also be disqualified in Sponsor’s sole
discretion.
H. Each Submission must be created and entered on an individual
basis only (i.e., no joint or corporate entries or entries on behalf
of any Finalist).
I. Each Submission must be an original work which is under no restriction,
contractual or otherwise that will prevent our use of the Submission
and each Submission must be free of any and all liens, encumbrances
and claims of third parties. Participant acknowledges, agrees and
warrants that, nothing in the Submission infringes on any copyrights,
confidential information, trade secrets or trademarks belonging
to any person or entity other than the Participant absent a suitable
license, clearance or permission agreement (proof of which is required
upon submission), or violates any person's rights of privacy or
publicity and that all necessary releases and permissions have been
secured.
J. By uploading the Submission onto the Lenovo Torchbearer Contest
Video Voting Page the participant agrees, for zero compensation,
to grant to Sponsor all intellectual property rights in the Submission
and each of its constituent parts, which rights include, without
limitation, the Sponsor’s right to publish, make available
to the public and/or reproduce the Submission through any media
available for the purpose of administering and conducting the Promotion.
All participants acknowledge and agree that Sponsor may use any
ideas from submitted materials, whether or not such material has
been awarded a prize.
K. Sponsor is not responsible for any expenses incurred in the production
and delivery of the Submissions.
L. Videos must conform to the YouTube
Code of Conduct.
M. No video with a replica of an Olympic Torch or any use of any
Olympic insignia, logo or content will be accepted or posted to
the site. The actual Beijing 2008 Olympic Torch Relay might not
reflect your idea.
N. Any Submission that does not comply with the above restrictions
or any other requirement herein is subject to disqualification and
Sponsor reserves the right at its sole discretion to remove any
Submission if Sponsor receives notification about any potential
infringements or breaches of law.
Grand Prize Winner Selection: All Submissions
will be posted on http://www.lenovo.com/torch
and will be voted upon by the general public. The top three (3)
Finalists, determined as those Finalists receiving the highest votes
on http://www.lenovo.com/torch
by 11:59 p.m. EDST on October 24, 2007 will each be selected as
grand prize winners (“Grand Prize Winners”) and each
such Grand Prize Winner will be awarded a trip for two (2) persons,
21 years of age or older, to China. (approximate retail value $6,000.00
USD each). Each of the Grand Prize Winners will have the opportunity
to participate in the Beijing 2008 Olympic Torch Relay in a city
in China to be advised at the time of announcement of the Grand
Prize Winners. The Grand Prize Winners will be required to sign
a participation agreement with BOCOG (Beijing Organizing Committee
for the Olympic Games) prior to participating as Torchbearer in
the Beijing 2008 Torch Relay. By signing this participation agreement,
the Grand Prize Winners will agree to abide by the rules that BOCOG
has set for Torchbearers in the Beijing 2008 Torch Relay. Failure
to comply with this agreement or engagement in serious misconduct
which, in BOCOG’s opinion, adversely affects BOCOG’s
interests or those of the IOC, BOCOG, the Beijing 2000 Olympic Games
or the Olympic Movement, may result in termination of Grand Prize
Winners’ participation in the Beijing 2008 Torch Relay by
BOCOG.
Each prize will consist of two round trip economy airfares from
the nearest major airport (in relation to Grand Prize Winner’s
place of residence) to China for each Grand Prize Winner and a travel
companion. It also includes twin share accommodation for a minimum
of two nights in China, minimum four star standard, it will also
include breakfast each day and at least one other meal. Torchbearer
Uniform is also included for the Grand Prize Winners. Not included
are any visas costs, local transport in your home city, and personal
expenses. All travel arrangements must be made by Sponsor’s
agent. Grand Prize Winners must arrange travel at least 60 days
in advance and winner and his/her travel companion must travel together
on the same itinerary. Exact travel times are subject to availability.
All other expenses not specifically identified in these Official
Rules are the sole responsibility of the Grand Prize Winners. The
travel companion of the Grand Prize Winners must be 21 years of
age or older. Each Grand Prize winner and his/her travel companion
is responsible for securing valid passports and/or any additional
required travel documents at their sole expense prior to travel.
The Grand Prize will be forfeited if winner is unable to travel
by 11:59 p.m. Eastern Standard Time (“EST”) on April
30, 2008. Travel changes will not be accepted after reservations
have been booked. The Promotion Entities are not responsible if
the Grand Prize, or any part thereof, cannot be awarded due to travel
cancellations, delays or interruptions due to any acts of God, action(s),
regulation(s), order(s) or request(s) by any governmental or quasi-governmental
entity (whether or not the action(s), regulations(s), order(s) or
request(s) prove(s) to be invalid), equipment failure, terrorist
acts, earthquake, war, fire, flood, explosion, unusually severe
weather, hurricane, embargo, labor dispute or strike (whether legal
or illegal), labor or material shortage, transportation interruption
of any kind, work slow-down, civil disturbance, insurrection, riot,
or any other cause beyond Sponsor’s sole control, and shall
not be responsible for any cancellations, delays, diversions or
substitutions or any act or omissions whatsoever by the air carrier(s),
hotel(s), or other transportation companies or any other persons
providing any of these services and accommodations to passengers
including any results thereof such as changes in services or accommodations
necessitated by same. Except in the cases of death or personal injury
caused directly by the intentional misconduct or gross negligence
of the Promotion Entities, the Promotion Entities shall not be responsible,
and will be held harmless, for any liability, loss, injury or damage,
including, without limitation, personal injury, death or damage
to personal or real property, to entrant or any other person or
entity due in whole or in part, directly or indirectly, by reason
of the acceptance, possession, use or misuse of any prize (including
any travel or activity related thereto).
Grand Prize Winners may be required to execute an Affidavit of
Eligibility (where legal), or, if a resident of the United Kingdom,
a “Certificate of Eligibility,” a Liability Release
(where legal), and a Publicity Release (“Affidavit/Release”),
or, if a resident of Canada, a Declaration of Compliance and Publicity
Release (“Declaration”), except where prohibited. The
travel companion of the Grand Prize Winners must also sign a Liability
and Publicity Release (where legal).
The approximate value of each Grand Prize trip to China is estimated
at $6,000.00USD. The total value of all Grand Prizes is estimated
at $18,000.00USD. There are no cash alternatives to any prize.
“Cloud of Promise” Torch Drawing:
After voting for the Grand Prize Winners, visitors to the Finalist
Submission voting page can enter the “Cloud of Promise”
torch drawing at http://www.lenovo.com/torch
by completing and submitting the online registration form beginning
at 10:00 a.m. EDST on October 10, 2007 and ending at 11:59 p.m.
EDST on October 24, 2007. Limit one (1) entry per person and per
email address. On October 31, 2007 three (3) winners (“Torch
Winners”) will be selected randomly from among all eligible
entries received and awarded a Lenovo-designed "Cloud of Promise"
Beijing 2008 Olympic Torch that reflects the traditions and history
of the Beijing Olympic Games and its host nation (approximate retail
value $500.00USD each). Odds of winning depend on the number of
eligible entries received. Before being declared a Torch Winner,
residents of Canada, Brazil and Argentina must also correctly answer,
without assistance of any kind, whether mechanical or otherwise,
a time-limited mathematical or cultural skill-testing question,
as applicable, to be administered by Sponsor. If the potential winner
does not successfully complete the skill-testing question within
the time specified by Sponsor, or does not respond to the prize
notification within seven (7) days, the potential winner will be
disqualified and an alternate winner may be selected. Any applicable
taxes, customs and duties on any prize are solely the responsibility
of the winner. Sponsor cannot obtain the actual Torch from BOCOG
until the Torch Relay ends in August 2008. Torch fulfillment will
occur in September/October, 2008.
The total value of prizes available to be won in the “Cloud
of Promise” Torch Drawing is estimated at $1,500.00USD. There
are no cash alternatives to any prize.
Submissions: Sponsor is not responsible for lost,
late, incomplete, invalid, illegible or misdirected entries or Submissions,
which will be disqualified; for technical failures of any kind,
including, but not limited to, electronic malfunctioning of any
network, hardware or software; or for any error, human, technical
or otherwise; or any injury or damage to Participant’s or
any other person’s computer related to or resulting from entering
or participating in this Promotion. Sponsor reserves the right at
its sole discretion to cancel or suspend this Promotion for any
reason whatsoever including, but not limited to, a computer virus,
bug, or other cause beyond the control of Sponsor. In case of dispute
as to the owner of an online entry, the online entry will be deemed
to have been submitted by the authorized account holder of the e-mail
address from which the entry is made. The "authorized account
holder" is the natural person assigned an e-mail address by
an Internet access provider, online service provider or other organization
responsible for assigning e-mail addresses for the domain associated
with the submitted address. A selected entrant may be required to
provide Sponsor with proof that he/she is the authorized account
holder of the e-mail address associated with the selected entry.
Sponsor reserves the right, in its sole discretion, to disqualify
any individual it finds tampering with the operation or entry process
of the Promotion, or acting in violation of these Official Rules
or applicable law. Submissions delayed past the submission deadline
of the Promotion Period will not be accepted for review and will
be destroyed. Submissions that do not opt-in to receive future correspondence
will be destroyed no later than the 30th of November 2007.
Personal Information: Personal information (including
name, address, email address, other information) provided by entrants
will be handled pursuant to the Lenovo Privacy Policy (available
online at http://www.lenovo.com/privacy)
and will be used only for the purposes of administering this Promotion,
except where an entrant agrees to accept further marketing materials
or otherwise expressly authorizes use of their data. Entrants consent
to their personal information being processed in connection with
this Promotion by Sponsor, its affiliated entities worldwide, and
Brandmovers, Inc.
General: The Promotion Entities reserve the right
to terminate, cancel, suspend and/or modify the Promotion without
liability and without prior notice if any factor interferes with
its operation as contemplated by these Official Rules, including
but not limited to any fraud, virus or other technical problem which
corrupts the administration, security, or proper operation of the
Promotion. Only one prize may be collected per household (same family
name, same address).
Except in the cases of death or personal injury caused directly
by the intentional misconduct or gross negligence of the Promotion
Entities, the Promotion Entities shall have no liability and shall
be released and held harmless by participant(s) for any damage,
loss or liability to person or property, including without limitation
any claim for infringement of intellectual property rights, due
in whole or part, directly or indirectly, by reason of the acceptance,
possession, use or misuse of prize or participation in this Promotion.
Participants assume all risk of loss, damage, destruction, delay
or misdirection of mail or email submitted to Sponsor. All prizes
are awarded upon the condition that the Promotion Entities shall
have no liability whatsoever, subject to the limitations set forth
herein, and shall be held harmless for any injuries, losses, or
damages of any kind to persons or property, including death, sustained,
in whole or in part, directly or indirectly, in connection with
or resulting from acceptance, possession or use/misuse of any prize,
or participation in the Promotion and any Promotion related activities
and further acknowledge that said parties have neither made, nor
are in any manner responsible or liable for, any warranty, representation
or guarantee, expressed or implied, in fact or in law, relative
to any prize, including but not limited to its quality, mechanical
condition or fitness for a particular purpose.
No cash or other substitution may be made, except by Sponsor, who
reserve the right, in their sole discretion, to substitute a prize
with another prize of greater or equal value in the event that a
prize is unavailable or cannot otherwise be awarded as described.
Any and all disputes, claims and causes of action arising out of
or connected with this Promotion, or any prize awarded, shall be
resolved individually, without resort to any form of class action,
and exclusively by arbitration (where legal). Claims, judgments
and awards shall be limited to actual out-of-pocket costs incurred,
including costs associated with entering this Promotion, but in
no event attorney’s fees.
Except where prohibited, all issues and questions concerning the
construction, validity, interpretation and enforceability of these
Official Rules, or the rights and obligations of the participant
and Sponsor in connection with the Promotion, shall be governed
by, and construed in accordance with, the laws of the State of North
Carolina, U.S.A. without giving effect to any choice of law or conflict
of law rules (whether of the State of NC, U.S.A. or any other jurisdiction).
Sponsor’s failure to enforce any term of these Official Rules
shall not constitute a waiver of that provision.
Winners List: For a list of prize-winners, which
shall be available for three (3) months after November 25th 2007,
